Councilman Burnett made a suggestion that the Council approve leaving the building line where it is now, put an exception in the Building Code that you can have a carport to exceed the Building line with no walls, in this the citizens would have to get the people on their block to approve the carport. Once everyone approved the carport, that would be a standing procedure that would be good on that block from now on in case any other citizens wanted to build carports later, and asked that this be turned over to the city staff to study for the feasibility of it. Councilman Shelton agreed with Councilman Burnett's suggestion, but he stated that he would like to see a moratorium on the action that has taken place in the past. Councilman Bell stated he would like to postpone action on this, so that we, can come up with a solution that would protect all the neighborhoods and the people who invested their money. Councilman Bell also wanted staff to look into ordinances that would enforce action against the builders. Councilman Burnett further requested that nothing be done about the notices until either the Council fines a solution to this, or it is a proven fact that it is going to stay like it is. After further discussion, Mayor Fisher instructed city staff to work on this between now and the Thursday meeting in April, and have an action item placed on the agenda for this matter. Jerry DeBin 845 S. E. 38th, appeared before the Council, voicing his concern regarding carports that were built ten years ago. Mr. DeBin asked the Council to consider grandfathering the existing structures, let the carports stand, but enforce the ordinance forward, because many of these structures went up with the City's blessing, and now.your are trying to enforce something against the citizens, and your are proposing up to a $2,000.00 per day fine, these people are not harden criminals you are talking about. City Manager Malone pointed out that the maximum fine is up to $2,000.00 a day, and the fine would be set by the Municipal Court Judge in any case that might get to the point of being filed. The fact that there were permits issued in error; of course, the staff regrets any errors that might have been made, and regarding the enforcement, we can not take action against some offense until it has been brought to our attention.
