Mr. McCollum told the City Attorney and Council that <br />yes it was part of the back yard but the next item is a replat adding <br />the 60 feet to this site plan. <br />Mayor Burnett called for proponents to appear, and Mr. Steve Elkins, <br />3380 E. Houston Street, appeared before the Council in behalf of the <br />Developer, explaining that in the spirit of the request of the <br />neighborhood regarding Arby's was to provide the distance between their <br />houses and Mr. Rod Kosterman's back yard, and that activity. Wi.th this <br />replat that there will also be a 60 foot green area between his house <br />and the commercial operation. <br />City Attorney Haynes stated that an additional 60 feet of green area is <br />needed from the property line for the council to be consistence. <br />After further discussion, a motion was made by Councilman Clifford to <br />table action on this matter. The motion was seconded. by Councilman <br />Wortham, and carried 5 ayes, 0 nays. <br />Mayor Burnett announced the next item on the agenda was consideration <br />of and action on approval of replat of Lot 9, Block B, Town East <br />Estates and Lot 18, City Block 296. <br />A motion was made by Councilman Clifford, seconded by Councilman <br />Wortham to table action on this item. The motion carried 5 ayes, 0 <br />nays. <br />Joe McCollum presented the final plat of Morningside North No. 1. A <br />motion was made by Councilman Fendley, seconded by Councilman Wortham <br />for approval of the final plat subject to the requirements of the City <br />Engineer. The motion carried 5 ayes, 0 nays. <br />City Attorney Haynes presented the following petitions for rezoning: <br />Ever L. Hilliard, Lot 9, City Block 102 -C from MF -1 District to General <br />Retail District; Donald G. Wilson of H -W Investments on part of Lot <br />14, City Block 259 from SF-2 District to Commercial District. <br />Mayor Burnett referred the petition to the Planning and Zoning <br />Commission for their study and recommendations and called for a public <br />hearing at the next regular Council meeting. <br />A motion -was made by Councilman Clifford, seconded by Councilman <br />Fendley to bring item number four and five of the agenda from the <br />table. The motion carried 5 ayes, 0 nays. <br />Mayor Burnett announced that the Council would continue the public <br />hearing on the petition of Sid Hollingsworth for a site plan approval <br />in a Planned Development - Retail District on Lot 18, City Block 296. <br />Steve Elkins was present and advised the Council that a new Site Plan <br />would be presented at a later date. <br />A motion was made by Councilman Clifford, seconded by Councilman <br />Fendley to table item number four and five, and continue the public <br />hearing on item number four.
