251 j <br />policy that a developer must bring utilities to his property from the <br />nearest available point, a set of drawings was prepared by the City <br />Engineer or his staff, and that a sewer line was constructed according to <br />this map, which was stamped as built, but.never signed, on this same map <br />there is a water line going within 150 feet of that property, but City <br />Manager Malone does not believe this was built because they made the <br />assumption, the city had given Mr. Abbott a tap on the city line, he had <br />service, there was a fire hydrant on Stone Ave, and at that time there <br />was no fire code, the fire hydrant was considered within a safe distance, <br />the city did not see any need to go to the expense of building that line, <br />but the map stayed in the files. <br />Mr. Abbott's now is involved in a transaction to sell his lot north of of <br />Abbott's Furniture, and his buyer comes to the city asking what he needs <br />to do to develop this property, and was told he would have to run sewer <br />from where the sewer exist up to the property, and was told water was <br />there, a 2" line runs across the lot. An opinion was offered to the <br />buyer that would be true except the new fire code requires a fire hydrant <br />within 150 feet of the building, and there is no main that close for a <br />commercial structure, that he would have to run the main to get the fire <br />protection yin. At this point, he was given additional misinformation, <br />relying on a drawing thinking that the main ended at Stone Ave., and he <br />was given an estimate of the costa <br />Mr. Bill Abbott appeared before the Council in behalf of his request <br />stating this is a plotted deeded lot, and was not subdivided, it was a <br />separate lot coming into the city on annexation. Mr. Abbott advised that <br />his buyer wishes to build a Medical Supply Company on this property, Mr. <br />Taylor checked with the city to see what he had to do to get water and <br />sewer service to this property. Mr. Abbott said they knew he would have <br />to extend the sewer line 150 feet. The City staff told Mr. Taylor that <br />the two inch water line was fine. Last Monday the City came back and <br />told Mr. Taylor they had made a mistake, that he would have to run a 6 <br />water line from the south side of Abbott Furniture, 1.50 feet of extension <br />because we did not have a fire hydrant. Tuesday the City staff said, <br />there was another error, the line will have to be extended 500 feet from <br />Stone Ave., the map was wrong plus the fire hydrant. Mr. Abbott said <br />after several meetings with City staff, they agreed to uncover the water <br />line, and found we had only a 300 feet extension to make. Mr. Abbott <br />agreed to put afire hydrant on the end of this line, Mr. Taylor agreed <br />to run the sewer line, but Friday the City Manager and City Attorney <br />informed Mr. Abbott they could not make a tap on a 2" water line. Mr. <br />Abbott said in his opinion, when the city made the two taps, they said <br />this is a city line, otherwise they would have told me to get a plumber <br />to make those tapes, and when property is annexed into the city with a <br />3/4" line those are city mains. <br />After further discussion, a motion was made by Councilman Clifford to <br />extend the water line, and not to go any further north of the water meter <br />on the south side. The motion died for lack of a second. <br />Mr. Abbott request that the city allow him to tap on to the 2" line and <br />install the water hydrant, and this would solve the problem. <br />I � <br />I <br />
