Funding for the proposed project is available in the Capital Improvements Budget for water mains, and stated that the Water Main would be in the Right-of-way instead of the Street. After discussion, a motion was made by Councilman Folmar, seconded by Councilman Bone to proceed with the project with funding from the Capital improvement Budget. The motion carried 7 ayes, 0 nays. City Manager advised that where we- are considering 28th N. W. from Graham to Campbell, this is a gravel street that shows signs of having pavement at one time. City Manager Malone told the Council that at the present time, there is a two inch water main with the absent of fire protection in the middle section of this area, there is a continual maintenance problem there, and records shows 28 repairs since 1980 at a cost of approximately $4,000.00 - $6,000.00. The Master Plan calls for a larger main, and it is felt that at this time in order to' furnish fire protection, and in order to make improvements to the street, the staff recommends that we use a six inch main as the larger main showing in the Master Plan is in conjunction with an overhead storage tank which would have to be considered in the future. After discussion a motion was made by Councilman. Hoog, seconded by Councilman Wortham for approval of the Water Main Replacement Project using funds from the Capital Improvement budget. The motion carried 7 ayes, 0 nays. City Attorney Haynes informed the Council that the matter of Whitaker right-of-way had been settled, the special Commissioners Court had awarded $32,100.00 which is lower than the amount authorized by the Council, and all of the eminent domain proceeding have been completed through the a missioner's stage, now it is up to the property owners if they wish to appeal or the City, and we do not wish to appear, and the property owners have 30 days in which to appeal, and Mr. Haynes said he would report at the next Council meeting. Mayor Burnett announced that the Council would go into executive session and declared the regular session closed and the executive session open.
