8 <br />MIN=S OF THE REGULAR COUNCIL MEETING OF THE CITY COUNCIL <br />February 9, 1987 <br />The City Council of the City of Paris met in regular session, Monday, <br />February 9, 1987, 7:00 P. M., Council Roan, City Hall. Mayor Billy <br />J. Burnett called the meeting to order with the following Councilmen <br />present: W. C. Francis, Travis Wortham, Jeff Hoog, Bill Bone, and <br />Addie Bufford. Also present was City Manager, Michael E. Malone, <br />City Attorney, T. K. Haynes, and City Clerk, Mattie Cunningham. <br />Prayer was offered by Reverend Wilburn Simmons. <br />Eddie Baker, 570 Paris Blvd. appeared before the Council, presenting <br />a petition signed by area residents objecting to a loud noise created <br />by some type of machine located at Wall Concrete Company. Mr. Baker <br />stated that vibrations from the machine has damaged his have along <br />with the noise which is unbearable, and requested assistance from <br />the City Council in correcting this problem. <br />City Attorney Haynes advised that Wall Concrete Company's property <br />was zoned correctly, that there is an Ordinance regarding amplified <br />music which prevents amplified music in a residential area at certain <br />times in the day. Mr. Haynes said he has talked to Ccopany <br />representatives about relocating the machine and found that the <br />machine was partly above ground and the Company thinks the vibrations <br />are transmitted in the air and not through the ground. Mr. Haynes <br />told the Council that the Wall. Concrete CaTpany had installed a brick <br />wall on the south side of their property to try and help the <br />situation. <br />Councilman Bone suggested to the Bakers that there was a possibility <br />of legal recovery through the courts. <br />Councilman Hoog suggested that city staff discuss this situation with <br />Wall Concrete Company in order to reach a workable solution to the <br />problem. <br />Councilman Folmar entered the council chambers and assumed his seat <br />at the council table. <br />Mayor Burnett asked if there were any corrections to the minutes of <br />previous meetings, there being none, the minutes were approved as <br />presented. <br />Mayor Burnett called for a report from the Street & Drainage <br />Committee for establishing procedures for developer's acquisition of <br />off -site drainage easements. <br />City Manager reported that at the January 21, 1987 Subcommittee <br />meeting the Street and Drainage Committee had approved the policy <br />that the City should protect downstream property owners from <br />increases in concentrated flow as a result of upstream developnent <br />and a procedure was developed to assist developers in acquiring <br />necessary drainage easement for off -site improvements as follows: <br />
