i <br />-4 81 <br />was presented. A motion was made by Councilman McGee, seconded by <br />Councilman Fisher to deny the re- zoning and to deny the adoption of <br />the Ordinance. The motion carried 7 ayes, 0 nays. <br />Mayor Graham declared the public hearing open on the petition of <br />Alfred T. Fangio for a change in zoning from a One- Family:Dwelling <br />District No. 3 to a Commercial District on Lots 8, 9, 10,'and 11, Block <br />1, Belmont Addition located on the southwest corner of Belmont Street <br />and 14th N. E. <br />Mayor Graham called for proponents to appear and Alfred T',. Fangio <br />appeared in his behalf stating that he proposed to re- construct a <br />60 x 40 metal building with a off set of 40 feet from the curb line <br />of the street for occupancy by a Body and Paint Shop. Mr' . Fangio <br />explained that the April 2nd tornado had destroyed his building and <br />that the proposed building was for re- construction. <br />Mayor Graham called for opponents to appear and Mr. Steve:. Mills, <br />Mr. Bill Felps, Paster of the Belmont Baptist Church, and Mr. Gilbert <br />0. Miller Chairman of the Board of Decons of Belmont Baptist Church <br />appeared in opposition to the petition. <br />Mayor Graham declared the public hearing closed and <br />ORDINANCE NO. <br />AN ORDINANCE AMENDING ZONING ORDINANCE NO. 1710, OF THE CITY OF PARIS, <br />PARIS, TEXAS, AND CHANGING THE BOUNDARIES ESTABLISHED BY THE ZONING <br />MAP OF SAID CITY; ESTABLISHING A COMMERCIAL DISTRICT (C) !ON LOTS 8, <br />9, 10, AND 11, BLOCK 1, BELMONT ADDITION TO THE CITY OF PIARIS, ON <br />PROPERTY BELONGING TO ALFRED T. FANGIO, SO AS TO INCLUDE THEREIN <br />TERRITORY FORMERLY DESIGNATED AS A ONE- FAMILY DWELLING DISTRICT NO. 3 <br />(SF -3): AND DESIGNATING THE BOUNDARIES OF THE COMMERCIAL DISTRICT (C) <br />SO ESTABLISHED. i <br />was presented. A motion was made by Councilman McGee, seconded by <br />Councilman Fisher for the adoption of the Ordinance. The vote was <br />taken which showed 5 ayes, 2 nays Councilman Francis, and Councilman <br />Wilson voting nay, and the Mayor declared the Ordinance failed be- <br />cause of the 75% rule in that the Planning and Zoning Commission had <br />voted negatively for the change. <br />The Director of Community Development, Joe McCollum appeared before the <br />Council and presented a re -plat of Lots 5 -8 and 13 -16 Block 2 Highland <br />Park Addition. Mayor Graham stated that he would invite comments from <br />members of the audience although there was not a public hearing on the <br />re -plat. Mr. Charles Waldrum appeared before the Council! and presented <br />a petition of 57 persons opposing the re -plat, and requested that the plat <br />remain as originally adopted. Mrs. Susan Kosterman appeared before the <br />Councilrequesting that the re -plat be denied. Mr. Vic Ressler appeared <br />before the Council speaking for the re -plat in behalf of the owner. Mr. <br />Hardy Moore also spoke in opposition to the re -plat. Mr.!! Scott Odom <br />owner of the property in question appeared before the Council request- <br />ing approval of the re -plat. After disucssion, a motion was made by <br />Councilman Francis, seconded by Councilman McGee to deny;the approval <br />of the re -plat and over ride the Planning and Zoning Commission's <br />recommendation. The motion carried 6 ayes, 1 nay, Counciilman McWaters <br />voting nay. <br />� i <br />
