9v0 <br />"AN ORDINANCE AMENDING ZONING ORDINANCE NO. 1710 OF THE CITY OF <br />PARIS, PARIS, TEXAS, AND CHANGING THE BOUNDARIES ESTABLISHED BY <br />T "t ZONING MAP OF SAID CITY; ESTABLISHING A COMMERCIAL DISTRICT <br />(C) ON LOT 6, CITY BLOCK 318, ON PROPERTY BELONGING TO J. 41. <br />McCOY, SR.,*SO AS TO INCLUDE THEREIN TERRITORY FORMERLY DESIG- <br />NATED AS AN AGRICULTURAL DISTRICT (A); AND DESIGNATING THE BOUN- <br />DARIES OF THE COMMERCIAL DISTRICT (C) SO ESTABLISHED." <br />was presented. A motion was made by Councilman Wunsch and seconded by Councilman <br />Fisher for the adoption of the ordinance. The motion carried: 7 ayes, 0 nays. <br />Mayor Brunette declared the public hearing open to consider the petition of H. L. <br />Ervin for a change in zoning from a Two - Family Dwelling District (2F) to a Commer- <br />cial District -(C) on Lots 5 and 6, City Block 189, located on the northwest corner <br />of 13th N. W. and Bonham Street. <br />Mr. H. C. Greene informed the mayor that a petition had been received this date with <br />eleven (11) names, eight of which were owners within 200 feet in opposition 'to the <br />proposed change. <br />Mayor Brunette called for proponents to appear, and Mr. Eric Clifford, representing <br />Mr. Ervin-, told the Council that Mr. Ervin had purchased this property thinking that <br />it was zoned commercial *and could be used for the sale of cars. He went on to say <br />that a garage had been in operation for over eight years at this location. Mr. <br />Clifford then presented a petition signed by fifteen (15) area owners in support of <br />the application, which contained several of the names who had signed the earlier <br />petition opposing the change. <br />L. C. Brown, Dudley Horton, Grace Melton, Eric and Florence Jordan and Philip Whita <br />ker were also present in support of the request. <br />Mayor Brunette called for opponents to appear, and J. D. McLaughlin appeared, stating <br />that the protest - petition had been filed through his office and had been signed by <br />eight landowners and three elders of the Bonham Street Church of Christ. Emory <br />Bridges, B. E. Cannon.and David Long, all elders of the Bonham Street Church of <br />Christ, also spoke in opposition to the proposed zoning change. <br />Mayor Brunette declared the public hearing closed and called for the reading of the <br />ordinance. <br />An ordinance was offered to change the zoning. Discussion by the Council centered <br />on whether specific restrictions could be placed on the zoning. The city attorney <br />stated that contractual considerations could. be placed in the ordinance for this <br />particular property if the Council so desired. <br />Mr. McLaughlin then requested that the request be delayed in order to work out some <br />restrictions with the applicant. Mr. Clifford stated that there was no change pro- <br />posed for the property and no additional buildings to be constructed and would not <br />object to the specific restrictions being placed on the property. <br />A motion was made by Councilman Stone and seconded by Councilman Fisher that the pub- <br />lic hearing on the application or petition be continued until the next meeting. The <br />motion carried: 7 ayes, 0 nays. <br />Mayor Brunette declared the public hearing open to consider the petition of Wayne <br />and Gene Brown for a change in zoning from an Agricultural District (A) to a General <br />Retail District (GR) on Lot 1, City Block 315, located on the northeast corner of <br />Loop 286 N. E. and Lamar Avenue. <br />
