The State law and the City law is the same <br />and he would like someone to explain who comes under these ordinances as being <br />a developer, and asked the City Attorney to do so. City Manager Malone said that <br />would be anyone who falls under the guidelines of the ordinance. City Manager <br />Malone said he was not prepared to discuss this at this time as this is a personal <br />appearance section. Mr. Ross read a section under the State and City laws as to <br />who qualifies, "it is any owner of any tract of land situated within the corporate <br />limits of the City of Paris or within the ETJ of any such City who may hereafter divide <br />the same in two or more tracts for purpose of laying out a subdivision." Mr. Ross <br />said it is pretty simple and they operate the same way in the county. You only come <br />under these rules if you purchase a piece of property, if you sell more than one tract <br />off, and there are some other exemptions but they are on existing state roads or city <br />streets. Mr. Ross said he felt the citizens of Paris, Texas, and those in Lamar County <br />should be real clear about them so they will know what the law is and who comes <br />under this law. Mr. Ross said he would like to see a special meeting called within <br />a week to discuss subdivision ordinances and to be inserted into the Master Plan <br />or considered for the Master Plan. <br />City Manager Malone advised that there is a Master Plan process underway and that <br />there have been a number of public meetings. He stated that input was being <br />received for the Master Plan. City Manager Malone told Mr. Ross that he was <br />welcome to forward any information that he wished to insert into the Master Plan <br />by writing a letter and it will be considered by the firm that the City has contracted <br />to perform that study. The Manager said that the study is going to look at the <br />subdivision regulations of the City of Paris and there will be some <br />recommendations. He stated that the term developer has been used rather loosely, <br />but that there are policies of the City of Paris that have been in effect for many years <br />and he believes those policies were followed in the case of Mr. McNeal. <br />Mr. Ross said those policies are not in an ordinance form where anyone can see <br />them, and there is a problem of who enforces the policies. Mr. Ross wanted to know <br />if the policies could be in the form of an ordinance so that he can see what the <br />policies are. Mr. Ross said he would like this Council to consider this request like <br />they did annexations and other items, establishing a committee to work with <br />developers, builders, and landowners, especially in the new ETJ area and the new <br />annexation area so everyone will know what is going on. <br />Mayor Neeley advised that a letter has been written to Mr. McNeal regarding this <br />issue. <br />Mayor Neeley called for consideration of and action on approving the appointment <br />
