The <br />motion carried 4 ayes, 0 nays. <br />-- A motion was made by Councilman Hunt, seconded by Councilman Neeley to <br />allow Councilman Bell to return to the Council meeting. The motion <br />carried 4 ayes, 0 nay, and Councilman Bell enter the Council Chambers <br />and assumed his seat at the Council table. <br />Mayor Pro Tem Fulbright declared the public hearing open to consider <br />the petition of Bobby Smallwood for a change in zoning from an <br />Agricultural District (A) to a Office District (0) on Lot 1, Block A of <br />the Townwood Estates, being number 2110 Stillhouse Road. <br />Mayor Pro Tem Fulbright called for proponents to appear, and Bobby <br />Smallwood, 3015 Margaret Street, appeared in behalf of his petition. <br />Mayor Pro Tem Fulbright called for opponents to appear, none appeared, <br />and the public hearing was declared closed. <br />A motion was made by Councilman Bell, seconded by Councilman Jenkins <br />authorizing preparation of an ordinance changing the zoning from an <br />Agricultural District to a Office District on Lot 1, Block A, Townwood <br />Estates, to be presented at the next regular Council meeting. The <br />motion carried 5 ayes, 0 nays. <br />City Manager Malone announced that the next item on the agenda was <br />action on approval of the final plat of Lots 26, and 27, City Block 91, <br />and advised that the recommendations of the City Engineer, Earl Smith's <br />is as follows: "I have reviewed the plat of the above referenced <br />property. It appears that the plat complies with the City of Paris <br />regulations with the following exceptions and /or additions. 1. <br />Certify taxes paid. 2. Provide appropriate signatures and seals on <br />original drawing. 3. Pay filing fee of $25.00 made payable to Lamar <br />County Clerk and delivered to the City Engineer's office. 4. Provide <br />additional 5' right -of -way. 5. Provide water and sanitary sewer taps <br />to each structure. 6. Provide curb and gutter. 7. Plat into 1 lot <br />only in order to conform to lot sizes required by Zoning Ordinance." <br />Earl Smith, City Engineer, was present telling the Council that this <br />Final Plat was submitted at the October Planning and Zoning <br />Commission's meeting in October and considered at that time, and it was <br />approved subject to all the conditions in his memo. Since that time <br />the owner has re- submitted it. just as it was submitted the first time <br />seeking a variance on the lot size. Mr. Smith explained the problem is <br />this is in an old part of town, it existed as three lots and there <br />were structures, old houses on each of the three lots, Mr. Johnson <br />acquired the property, tore down the old houses, and started to build <br />new duplexes on the lot which is in accordance with the zoning. Mr. <br />Smith said during the course of construction, one of the duplexes <br />foundation encroached on the lot lines, and that prompted the replat, <br />so that is the only error that has been made in this matter. Planning <br />and Zoning felt like there was no major harm done, and we have only <br />shifted one lot line a few feet, the only way he could comply with any <br />
