036 location of private clubs at 3320 Lamar Avenue, 725 7th Street N. W., and 1175 7th Street N. W., and advised that the City has received citizens inquiries concerning the establishment of private clubs at several areas in Paris. Dr. Wilbur Simmons, Pastor of Ramseur Baptist Church appeared before the Council telling the Council that it had come to their attention that there is a pending application to sell alcohol on the property adjoining their church now known as Anthony's. Or. Simmons said that the sale of alcohol at this location would severely damage their congregation and the surrounding neighborhood, and believed that it violates City and State Laws along with being a direct conflict with the beliefs of the congregation, that it would create an environment which would endanger our members. Mr. Simmons asked the Council to review this application and urged that the City deny this application for a license to sell alcoholic beverages. City Attorney Haynes advised that there is State Law that prohibits this if the front door of the establishment is with in 300 feet of the front door of the church, but that he had been told by people at the church that it is over 300 feet. Councilman Jim Bell pointed out that this is not a public hearing, and we are conducting one, and unless the property owners involved were given proper notice, he felt that we were taking action without giving them appropriate notice to public hearings concerning their property. Mr. Bell said that we were singling out individual properties, we have another problem that we are creating. Mayor Fisher requested City Attorney Haynes the agenda, and the way it is listed on the we can allow citizens to address what they the agenda. to explain item number 9 of agenda as to whether or not requested to be placed on City Attorney Haynes advise that is with in the chair's prerogative to permit people to speak with regard to matters that are on the agenda. City Attorney Haynes said he did not think it necessary to declare a Public hearing for ever item on the agenda in order to have people to speak, and with regard to this item, the State of Texas Law permits private club license application on the ground that is stated and as read by Dr. Simmons, which they are asking the Council to take a Position on. Councilman Bell said it would be appropriate for the Council to take action in regard to an application, and at this point there is no application at this time, that we are taking action against a man that owns the property where there is no application. City Attorney Haynes told the Council that this item was on the agenda to authorize preparation of a resolution to be presented at a later date to the Council. The State will notify the Police Department if someone applies for a private club in the City.
