Mr. McCollum advised that there is no permit, but there is Planned <br />Development that would be a more restrictive use than the requested <br />Commercial District (C). <br />City Attorney Haynes pointed out that Item No. 17B referring Lots 1 and <br />2, Block 2, Fitzhugh Addition to the Planning and'Zoning Commission for <br />consideration for appropriate zoning is the same property that we are <br />talking about, and the reason for 17B being on the agenda for the <br />Council's consideration is to determine whether or not they think that <br />some action should occur down there is because of the objections from <br />residence in the neighborhood concerning the. club activity and what <br />goes with it, so under 17B, the Council is going to have an item to <br />consider to send this to the Planning and Zoning Commission for their <br />recommendation as to what an appropriate zoning classification would be <br />to better blend into the residential uses that surrounds this <br />property. City Attorney Haynes also advised that there is an order <br />from the Court concerning the desegregation plan for the public housing <br />in that section of town. Mr. Haynes said that one of HUD's <br />recommendation is this property be zoned to be compatible with the <br />neighborhood. <br />Tony Rios, Executive Director of the Paris Housing Authority, appeared <br />before the Council opposing the zoning change, and presented the <br />Council with a petition signed by residents of the Booker T. Washington <br />Public Housing Project in opposition. Mr. Rios told of several <br />disturbances at the club at this location. Mr. Rios pointed out that <br />the State of Texas has just granted a Community Block Grant to the City <br />for widening Martin Luther King Drive, and this application was <br />supported by the Housing Authority to improve the residential area, and <br />Mr. Rios read from a Federal Court Desegregation Order relative to <br />public housing in Paris which pointed out the effect of the nite club <br />on the adjacent residential uses. <br />Mr. Rios also pointed out that there was also a drainage problem from <br />the property in question which needs repairing. <br />Karl Louis, Paris Police Chief, was also present speaking in opposition <br />to the zoning change. Mr. Louis pointed out that every time the doors <br />are open to the nite club, we' have civil unrest, and requested the <br />zoning change by denied. <br />Mr. Hall address the matter of the drainage telling the Council the <br />water was coming from a natural spring, and has tried to correct the <br />drainage, but was unable to do so. <br />No one else was present to speak for or against the zoning change, and <br />the public hearing was declared closed. <br />A motion was made by Councilman Bell, seconded by Councilman Shelton to <br />table action on this request for a zoning change. The motion carried 5 <br />ayes, 0 nays. <br />A motion was made by Councilman Bell, seconded by Councilman Shelton to <br />bring item No. 17B forward. The motion carried 5 ayes, 0 nays. <br />Resolution No. 93 -002, resolving that the matter of appropriate zoning <br />on Lots 1 and 2, Block 2, Fitzhugh Addition, be, and the same is hereby <br />referred to the Planning and Zoning Commission of the City of Paris for <br />its recommendation concerning the proper zoning, and calling a public <br />hearing to be held by and before the Planning and Zoning Commission of <br />the City of Paris at 5:30 P. M., in the City Council Room, City Hall, <br />Paris, Texas, on the 1st day of February 1993, and a public hearing to <br />be held by and before the City Council of the City of Paris at 6:00 P. <br />M., in the Counci- l-Room,, City'Hall, Paris, Texas on the 4th day of <br />February, 1993, concerning the appropriate zoning on said property, was <br />presented by City Attorney Haynes. A motion was made by Councilman <br />Bell, seconded by Councilman Brown for approval of the resolution. The <br />motion carried 5 ayes, 0 nays. <br />
