♦s F. _ <br />F <br />3 <br />Chairman Hayter declared the public hearing open on the petition of <br />Beverly McKee for a change in zoning from a One Family Dwelling <br />District No. 2 (SF -2) to a Commercial District (C) on Lot 1, Block <br />10, Town North Estates located on the northwest corner of <br />Collegiate Drive and Kessler Drive. <br />No one was present to represent the request. <br />Approximately ten persons were present in opposition to the change. <br />Mike Hutchins, 1220 Collegiate Dr. presented a petition opposing <br />the change saying that it would severely devalue their homes. <br />No one else spoke and the public hearing was closed. <br />A motion was made by Mr. Clifford, seconded by Ms. Ausbie to <br />recommend denial of the petition. The motion carried 7 ayes, <br />0 nays. <br />Mr. Clifford asked to be excused from discussion of the next item <br />due to conflict of interest and left the meeting. <br />Chairman Hay-ter opened the public hearing to consider the <br />abandonment and closing of a portion of E. Center Street from the <br />north boundary line of N.E. Loop 286 north and east to it's <br />intersection with the proposed extension of 31st N.E. <br />Mr. Ed Ellis, representing Oak Creek Properties, spoke in favor of <br />the proposed street closing. He reminded the Commission that the <br />closing was part of the decision to amend the Master Plan providing <br />for the extension of 31st N.E. from the Loop north to F.M. 195. He <br />said the roadway is not maintained and that there was a proposal to <br />relocate a gas main in the present right of way. <br />A.W. Clem, IV representing Rueben Burnett, spoke in opposition <br />saying that his client needed the street for access to his barns, <br />corrals and cattle operation. He said that access from the east <br />was sometimes difficult due to drainage problems. He suggested <br />that the gas main could be relocated in the street without closing <br />it. <br />Mr. Burnett stated that the 31st N.E. extension would divide his <br />property and devalue it. He ask that it be left as it is. <br />Mr. Ellis stated the street closing and Master Plan amendment was <br />discussed at the time zoning was established on the property sold <br />to Ross Ward by Mr. Burnett. <br />Earl Smith, City Engineer, advised the Commission that Lone Star <br />Gas needed an exclusive easement for the gas transmission line and <br />would not relocate it in Center Street. <br />
