b _i <br />RESOLUTION NO. 85 -011 <br />WHEREAS, the City of Paris did heretofore in Resolution <br />No. 84 -049 authorize contracting with Dual Construction, <br />Inc., for emergency repair and restoration of the Central <br />Interceptor Sanitary Sewer, City of Paris, Paris, Texas; <br />and, <br />WHEREAS, an abnormal amount of rainfall and continued <br />wet soil conditions have precluded the contractor from <br />making final repairs to utility cuts which represent a small <br />dollar amount of the total contract and the final acceptance <br />of the rest of the project, the beginning of the warranty <br />period and the continued holding of the retainage would <br />unduly penalize the contractor which can be corrected by <br />Change Order No. 1, attached hereto as Exhibit A; and, <br />WHEREAS, such Change Order should be approved; NOW, <br />THEREFORE, <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />PARIS, That Change Order No. 1 to emergency repair and <br />restoration of the Central Interceptor Sanitary Sewer <br />contract with Dual Construction, Inc., is hereby approved; <br />and, <br />BE IT FURTHER RESOLVED That Joe Graham, Mayor of the <br />City of Paris, be, and he is M hereby authorized and directed <br />to execute said Change Order. <br />Passed and adopted this 11th day of February, 1985. <br />J e Gra am, Mayor <br />ATTEST: <br />Mat tie Cunningham, Ass "stant City Clerk <br />APPROVED AS FOR1',1: <br />T. Haynes, City Attorney <br />Resolution No. 85 -012 authorizing and directing the Mayor to execute on behalf of <br />the City of Paris with Tank Builders, Inc. a contract for tank floor repair and <br />installation of cathodic protection systems was presented. A motion was made <br />by Councilman Wilson, seconded by Councilman Hoog for approval of the Resolution. <br />The motion carried 7 ayes, 0 nays. <br />
