The motion carried 6 ayes, 1 nay Council- <br />man Kohls voting nay. <br />City Manager Sokoll presented the final plat Meadow Park Addition No. 2 for <br />final approval. Director of Public Works, Darrell Gunn appeared before the <br />Council and presented exceptions to the final plat. Mr. Charles Waldrum, <br />Attorney, appeared before the Council in behalf of the sub - dividers and questioned <br />the amount of bond, the drainage easement for off site drainage, and requested <br />that the permanent easement for drainage be subject to change in the event drainage <br />be, changed at a later time. After much discussion, a motion was made by Councilman <br />Burnett, seconded by Councilman Francis approving the final plat of Meadow Park <br />Addition No. 2 subject to the engineers requirements. The motion carried 7 ayes, <br />0 nays. <br />City Attorney Haynes presented the following petitions for re- zoning: R. B. Staples, <br />Jr. and Joel D. Casey 3515 Audubon Road, Part of Lot 1, City Block B from SF -2 <br />District to 2F District; Joe G. and Kay Smith, 3095 Lamar Apt 210, Lot 1 -A, <br />City Block 328 from Planned Development- Housing Dev. District to Neighborhood <br />Service District; Ramseur Baptist Church, 3400 Lamar, from SF -3 District to GR <br />District. <br />Mayor Malone referred the petitions to the Planning and Zoning Commission for <br />their study and recommendations and called for a public hearing at the next <br />regular Council meeting. <br />Mayor Malone called the Council's attention to recommendations made by the Traffic <br />Commission concerning streets adjacent to First Ward School, Fourth Ward School, <br />and East Paris School. A motion was made by Councilman Burnett, seconded by <br />Councilman Wortham authorizing the preparation of an Ordinance encompassing <br />the recommendation of the Traffic Commission. The motion carried 7 ayes, 0 nays. <br />Mayor Malone declared the public hearing open on the proposed water and sewer rate. <br />Mr. Tom Gartland, Vice President, and General Manager of the Campbell Soup Company, <br />Paris, Texas appeared before the Council requesting the Council to reconsider <br />its position of a 54% increase on the bottom rate in the step rate structure. <br />No other person appeared for the hearing and the public hearing was declared closed. <br />ORDINANCE NO. 2517 <br />AN ORDINANCE OF THE CITY OF PARIS, PARIS, TEXAS, PROVIDING THAT THE CODE OF <br />ORDINANCE, CITY OF PARIS, BE AMENDED BY REVISING SECTION 31 -17, 31 -18, 31 -19, <br />31 -20, AND 31 -24 OF SAID CODE; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES <br />IN CONFLICT HEREWITH; PROVIDING FOR AN INCREASE IN THE WATER AND SEWER RATES <br />AND ANNUAL REVIEW OF THE SAME; AND PROVIDING FOR AN EFFECTIVE DATE OF SUCH <br />RATES AND AN EFFECTIVE DATE OF THIS ORDINANCE OF JULY 14, 1980. <br />was presented. The motion carried 5 ayes, 2 nays, <br />Councilman Kohls, Councilman Kyle voting nay. <br />City Manager Sokoll made presentation on the on going projects of the City. <br />Mayor Malone called for the tabulations of bids for the 17th Street S. E. Drainange <br />Project, and the following bids were presented: <br />JE -AN Construction Co., Garland $ 96,949.40 <br />Zack Burkett Co., Graham 166,908.85 <br />Fair Way Equipment Co., Inc., Houston 136,930.27 <br />001 Construction Co., Texarkana 118,526.90 <br />City Manager Sokoll recommended that the bid of the Dual Construction Company, <br />Texarkana, Texas, in the amount of $118,526.90 be awarded rather than the low <br />bid of the JE-AN Construction Company. <br />Resolution No. 2039 accepting the bid of the Dual Construction Company, Inc., in <br />the amount of $118,526.90 and authorizing the Mayor to execute a contract for <br />the 17th Street S. E. Drainage Project was presented. A motion was made by <br />Councilman Burnett, seconded by Councilman Wortham for adoption of the Resolution. <br />Concern was presented as to the reason the bid was not awarded to the lowest bidder. <br />Following discussion, a motion was made by Councilman Burnett, seconded by Council- <br />man Kyle to table the matter until discussion could be had in an executive session. <br />The motion carried 7 ayes, 0 nays. <br />
