4 <br />t <br />MINUTES OF THE RFrTTLA.It MEETING OF THE CITY COUNCIL <br />March 13, 1978 <br />The regular meeting of the City Council was held on Monday, March 13, 1978 at 7:00 P.M. <br />Mayor James M. Brunette called the meeting to order with the following Councilmen <br />present: George Fisher, Jr., Michael Malone, David Philley, Jimmy Don Stoney Walter <br />F. Williams and Raymond Wunsch. Also present were Acting City Manager H. C. Greene, <br />City Attorney T. K. Haynes and Acting City Clerk Joe McCallum. <br />Prayer was offered by Jimmy Newman, Pastor of the College Church of Christ. <br />Mayor Brunette asked if there were additions or corrections to the Minutes of previous <br />meetings. There being none, the riinutes were approved as presented.. <br />1 <br />Mayor Brunette announced the first order of business would be consideration of recomm- <br />endations made by the Planning and Zoning Commission. <br />He declared the Public Hearing open on the petition of Mike Julian for a change in <br />zoning from a One Family Dwelling District No. 2 (SF -2) to a Multi- Family Dwelling <br />District No. 1 (NF-1) on Lots 12 and 13, City Block 259 located on the northside of <br />E. Cherry Street at 28th N.E. <br />A.W. Clem, representing the applicant, told the Council that due to the size and shape <br />of the tract of land, the requirement of a major thoroughfare through the tract and <br />drainage considerations; it was not feasible to develop for single family use. He <br />stated the Planning and Zoning Commission had recommended Planned Development Zoning <br />for the property but that MF -1 zoning was preferred and requested. <br />Councilman Philley asked if Multi- Family use would change the drainage problem and <br />was advised that it would not. <br />Councilman Malone asked if the applicant wished to drop the Planned Development as <br />recommended by the Planning and Zoning Commission. Mr. Clem advised yes. ` <br />Mayor Brunette called for opponents to the petition and Don Gordon, attorney, represent- <br />ing several area property owners presented arguments to the proposed change. Eleven <br />persons were present in opposition. <br />Mr. Gordon presented a petition against the change stating it would have a harmful <br />effect on the neighborhood. <br />Jack Denman, sirs. Ethel McGee and Ben F. Dodson, Jr. also spoke against the petition. <br />Mayor Brunette declared the Public Hearing closed. <br />A motion was made by Councilman Philley, seconded by Councilman Fisher to refer the <br />petition back to the Planning and Zoning Commission for additional consideration.
