MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL'S 5

<br />The Regular Meeting of the City Council was held on February 10, 1975 at 7:00 P. M.
<br />Mayor James M. Brunette called the meeting to order with the following Councilmen
<br />present: Joe King, Brad Hutchison, 0. L. Rainey, W. M. (Dub) Moore, and Sam M. Stone.
<br />Also present were City Manager K. R. Sweatt, City Attorney T. K. Haynes, and City
<br />Clerk H. C. Greene.
<br />Prayer was offered by Reverend Charles Replogle, minister of Paris Bible Church.
<br />Mayor Brunette asked if there were any corrections to the minutes of previous
<br />meetings as furnished the members of the Council. There being none, the Minutes
<br />.were approved.
<br />Mayor Brunette announced that prior to consideration of recommendations made by the
<br />Planning and Zoning Commission at its meeting on February 3, 1975, the matter of a
<br />final plat, a re -plat of Lots 1 and 2, City Block 113 -A and Lots 13, 10, and part
<br />of Lots 12, 11, and 9 of the Felts -Fort Varner Addition, property being developed by
<br />Dr. Walker and Dr. Bercher, would be considered, as this was tabled from the January
<br />meeting. Mr. A. W. Clem, Attorney, and Dr. Larry Walker both appeared before the
<br />Council, stating that they were willing to dedicate 10 feet of right -of -way in ques-
<br />tion, if the City would commit to widen Austin Street. Otherwise, Dr. Walker stated
<br />that he did not wish to dedicate 10 feet of right -of -way on Austin Street at the
<br />present time until time came for the development of the street and all property owners
<br />were treated in a like manner. After discussion, a motion was made by Councilman
<br />Rainey and :seconded by Councilman Stone to approve the plat as is, subject to the
<br />Director of Public Works requirements and with the exception that dedication of right -
<br />of -way is not required. The motion carried: 6 ayes, 0 nays.
<br />City Attorney Haynes presented the final plat of Morningside Estates, Part III. A
<br />motion was made by Councilman Rainey and.seconded by Councilman Moore that the final
<br />plat be approved, subject to the engineers' requirements. The motion carried: 6
<br />ayes, 0 nays.
<br />City Attorney Haynes presented a petition from Jim F. Kirby to re -zone Lot 35 -D,
<br />City Block 249 from Neighborhood Service District to General Retail District. Mayor
<br />Brunette referred the petition to the Planning and Zoning Commission for their study
<br />and recommendation and called for a public hearing at the next regular Council Meeting.,
<br />City Manager Sweatt advised the Council that the Airport Advisory Board had recom-
<br />mended that the present. airport operators be allowed to continue under 1974 permits
<br />and defer 1975 permit requests, allowing time for review of conflict with City ordi-
<br />nances and Operating Manual provisions with the requested permits. A motion was made
<br />by Councilman Hutchison and seconded by Councilman Rainey that the recommendatioft be
<br />approved. The motion carried: 6 ayes, 0 nays.
<br />Ordinance No. 2209:
<br />"AN ORDINANCE FIXING THE DATE FOR A PUBLIC HEARING ON PROPERTY
<br />ON WEST BRAME STREET, FROM THE WEST BOUNDARY LINE OF 25TH STREET,
<br />S. W., WEST APPROXIMATELY 851 FEET TO THE WEST BOUNDARY LINE
<br />OF LOT 8, BLOCK C, AND LOT 17, BLOCK D; PORTER'S SECOND ADDITION,
<br />AND ON WEST SHERMAN STREET, FROM THE WEST BOUNDARY LINE OF 25TH
<br />STREET, S. W., WEST APPROXIMATELY 861 FEET TO THE_WEST BOUNDARY
<br />LINE OF LOT 13, BLOCK A, PORTER'S FIRST ADDITION, AND LOT 1,
<br />BLOCK C, PORTER'S SECOND ADDITION, IN THE CITY OF PARIS, PARIS,
<br />TEXAS; DIRECTING THE CITY CLERK OF THE CITY OF PARIS TO-PUBLISH
<br />THE SAME THREE (3) TIMES IN THE PARIS NEWS AS REQUIRED BY LAW;
<br />APPROVING AND ACCEPTING THE FINAL ESTIMATES OF COSTS AND CON -
<br />STRUCTION PLANS OF SUCH STREET IMPROVEMENTS AS FILED BY THE
<br />DIRECTOR OF PUBLIC WORKS OF THE CITY OF PARIS; FIXING THE CHARGES
<br />TO BE ASSESSED AGAINST THE ABUTTING PROPERTY OWNERS AND THE
<br />CHARGES TO BE PAID BY THE CITY OF PARIS; AND WITH THE INTENTION
<br />OF FIXING A CHARGE AND LIEN AGAINST THE REAL AND TRUE OWNERS OF
<br />SAID PROPERTY AND AGAINST THE SAID PROPERTY ITSELF."
<br />was presented. A motion was made by Councilman Rainey and seconded by Councilman
<br />King that the ordinance be adopted. The motion carried: 6 ayes, 0 nays.,
