210 <br />F. Assure that no funds received under the Act will be used to hire- any persort- <br />to fill a job opening created by the action of an employer in laying off or termin t- <br />ins tie employment of any other regular employee- not supported under the Act in anti <br />cip:ation of. filling the vacancy so created by hiring an employee to be supported <br />under the Act; . <br />G. Assure that due consideration be given to persons wbo nave participated i.n- <br />ranpower training programs for whom employmant opportunities could not be othe11 -7ise <br />irwiiediately available; <br />ii. Assure that periodic review procedures established pursuant to Section 247(a) <br />of tla^ Act will be complied with; <br />1. fissure that it has undertaken or will wzdertalce, analyses of job descrip- <br />tions and reevaluations and, where shocm necessary, revisions of qualification re.- <br />quirements at all levels of eraploymcnt, including civil service requirements and <br />practices relating thereto, in accordance with regul-ations presc-ribed by the Secretary, <br />with a view toward removing artificial barriers to public employment of those whom it <br />is. the purpose of the Act to assist; .7 <br />J. Assure that the program ;grill, to the maximum extent feasible, contribute to <br />the elimination of artificial barriers to employment and occupatiiopa-I..advaazceaiaenC3 <br />including civil service requirements which restrict employment opportunities for the <br />..disadvantaged; <br />11. Assure that not more than one -- third of the participants in the program tra_ll <br />be employed in a bona fide professional. capacity (as such - terra is used in Section <br />13 (a) (1) of the Fair Labor. Standards Act of 1938) , except that this paragraph 'shall <br />not be applicable in the case of participants employed as classroom teachers, and the <br />Secretary may waive this limitation in exceptional circuaastances; <br />11.
