738 <br />Mrs. C. M. Morgan appeared An behalf of the Harry Jenkins estate, stating that the lot <br />had not been cleaned up after construction. <br />Mr. 0. O'Hare appeared in .behalf of Mr. Michel Halbouty, stating that the improvements <br />to the street did not accrue to the benefit of Mr. Halbouty but to the citizens of <br />Paris, and that he feels the value of the Halbouty property had been diminished. <br />Director of Public Works and City Engineer Ennis Killingsworth appeared before the <br />Council, stating the cost of the .project. Mr. Richard Stauter, Department of High- <br />ways and Public Transportation, appeared before the Council, stating that curb and <br />gutter and storm sewer was.the;responsibility of the City of Paris and that the paving <br />was the responsibility of the State. <br />City Attorney Haynes advised the Council that notices of the improvements had -been <br />given as prescribed by state law. <br />City Manager Sweatt advised that bids had been solicited by the state; that the bene- <br />fits received -by the property owners were equal to or greater than the cost of curb <br />and gutter.and driveways. <br />Mayor Brunette declared the public hearing closed, and Ordinance Flo. 2290° <br />"AN ORDINANCE CLOSING THE HEARING GIVEN TO THE REAL AND TRUE <br />OWNERS.OF PROPERTY ABUTTING UPON A CERTAIN STREET AND HIGHWAY <br />IN THE CITY OF PARIS, TEXAS, WITHIN THE LIMITS HEREINAFTER DE- <br />FINED, AS TO SPECIAL: BENEFITS TO ACCRUE TO SAID PROPERTY AND <br />THE REAL AND TRUE OWNERS THEREOF BY VIRTUE OF IMPROVEMENT OF <br />SAID STREET AND HIGHWAY WITHIN SAID LIMITS, AND AS TO ANY ERRORS,, <br />INVALIDITIES OR IRREGULARITIES IN ANY OF THE PROCEEDINGS OR <br />.CONTRACT THEREFOR; OVERRULING AND DENYING ALL PROTESTS AND <br />OBJECTIONS OFFERED; FINDING AND DETERMINING THAT EACH AND <br />EVERY PARCEL OF PROPERTY ABUTTING UPON SAID STREET AND HIGH - <br />WAY WITHIN THE LIMITS DEFINED WILL BE SPECIALLY BENEFITTED <br />AND ENHANCED IN VALUE IN EXCESS OF THE AMOUNT -OF THE COSTS <br />OF SAID IMPROVEM €NTS PROPOSED TO BE AND AS ASSESSED AGAINST <br />SAID PROPERTY AND THE REAL AND TRUE OWNERS THEREOF, AND LEVY- <br />ING AN ASSESSMENT FOR THE PAYMENT OF A PORTION OF THE COSTS OF <br />IMPROVING SAID STREET AND HIGHWAY WITHIN SAID LIMITS DEFINED, <br />FIXING A CHARGE AND LIEN AGAINST SAID PROPERTY AND THE REAL AND <br />TRUE OWNERS THEREOF, FIXING THE MANNER AND TIME OF PAYMENT <br />THEREOF, AND PROVIDING FOR THE MANNER AND METHOD OF SAID PAYMENT." <br />was presented. A motion was made by Councilman Hinds and seconded by•Councilman <br />Williams for the adoption of the ordinance. A poll of the Council. showed 3 ayes, 4 <br />nays. Further discussion was had concerning the project, and the Council was advised <br />that right -of -way had been purchased from each property owner, including Mr. Michel" <br />Halbouty. <br />After further discussion, a motion was. made by Councilman Williams and seconded by <br />Councilman Stone for the adoption of the ordinance."
